1. Purpose

These terms of service are intended to ensure the safety of visitors to Asahikawa Snow Land Daiba (“the facility”), which is operated by Asahikawa Golf Club Co., Ltd. (“the company”). These terms of service shall apply to visitors using the Facility (“customers”). Customers must abide by these terms of service when using the Facility. Matters not stipulated in these terms of service shall be handled based on relevant laws and regulations. Matters not covered by relevant laws and regulations shall be handled in accordance with the Japan Association for Skiing Safety (JASS) Standards on Snow Sports Safety, as revised in October 2013, and societal norms.

2. Scope of Application

Each attraction within the Facility presents distinct risks. Particularly in matters relating to speed, each individual has a responsibility to avoid becoming involved in accidents and to respect the safety of other customers. All customers therefore have a duty to act with due care and attention. Take particular care regarding the matters stated in the next section.

  1. Prohibition of actions that endanger other customers
    Avoid injury to other Customers and damage to the property of other customers while inside the Facility.
  2. General precautions during activities
    Always look carefully at conditions in front of you while driving and operating equipment. Consider factors such as physical condition, skill, terrain, weather, snow quality, and crowding, and adjust your speed accordingly. Always take care to avoid other customers or objects.
  3. Consideration of people in front
    When approaching another customer from the rear, adjust your direction and speed so that you do not interfere with or endanger people in front of you.
  4. Overtaking
    When overtaking, leave sufficient space to ensure that, regardless of what the person who you are overtaking does, there is no risk of an accident.
  5. Confirmation of surroundings
    When joining trails, crossing trails, and setting off, pay attention to the situation in front of you, behind you and on either side to ensure that there is no danger to you or other customers.
  6. Wearing safety equipment
    Wear a helmet when taking part in activities.
  7. Compliance with signs, warnings and instructions
    To prevent accidents, always obey the area rules (the terms of service), and signs, notices, and announcements in the facility, and always follow instructions from facility staff.
  8. Cautions when using free spaces (including kids’ area)
    When using free spaces, in addition to obeying all precautions, be aware of the equipment within the free space (mini skis, sleds, bubble suits, etc.) and always act within the bounds of your own knowledge and abilities. Ensure that the area around items is safe before starting use. The company cannot accept liability for injuries, accidents, etc.
  9. Responsibilities of guardians and other people accompanying children
    Guardians and other people accompanying children should assess the abilities of the children with them and ensure that children are not exposed to danger. Guardians and other people accompanying children must inform children of the rules that must be observed at the facility, including these terms of service.
  10. Duty of mutual assistance and cooperation
    In the event of an accident, regardless of whether you are personally involved, provide assistance and report the accident to facility staff. In such cases, you may be asked to verify your identity, regardless of whether you were involved in the accident or were a witness.

3. Cautions

When engaging in snow activities, the factors listed can lead to dangerous situations. In order to ensure that activities are safe and enjoyable, ensure that you remain aware of this fact and act with due care and attention.

  1. Falling snow, rain, strong winds, dense fog, and other weather-related factors
  2. Ponds, slopes, unevenness, grooves, and other terrain-related factors
  3. Ice burns, deep snow, snow quality, and snow surface conditions
  4. Trees, exposed ground, and other natural obstacles
  5. Collisions with struts, snowmaking equipment, buildings, signs, ropes, mats, and other human-made structures
  6. Approaching or colliding with other customers
  7. Individual errors
  8. Collisions with snow vehicles of any type
  9. Dangers related to use of free spaces
  10. Excessive speed
  11. The effects of tiredness, alcohol, medication, and physical unwellness
  12. Inappropriate use of equipment
  13. Other dangers similar to those listed above

4. Prohibitions

The following actions are prohibited at the facility.

  1. Entering closed trails or out of bounds areas
  2. Entering when the facility is closed (at night, etc.)
  3. Deliberately riding close to other customers or human-made and natural objects
  4. Actions that obstruct operations
  5. Getting close to any snow vehicle in operation
  6. Damaging displays, notices, or signs
  7. Throwing away or leaving empty cans, cigarette butts and other items in locations other than the designated areas
  8. Unnecessarily walking on trails while wearing shoes
  9. Releasing dogs or other animals onto trails
  10. Entering the facility or using facilities when in a physical or mental state impaired by alcohol, drugs or other factors
  11. Unauthorized reselling of admission tickets
  12. Actions prohibited by laws, regulations, etc.
  13. Stopping and sitting on trails for prolonged periods
  14. Other actions that risk the safety of other customers or of the individual concerned
  15. Leaving luggage in hallways in restaurants and other facilities or in communal spaces

5. Claims for Compensation and Bearing of Costs

  1. The company accepts no liability whatsoever for accidents that occur as a result of actions that violate these terms of service or that violate rules of conduct, warnings and prohibitions specified by the facility. Accordingly, in the event that the company incurs damages or compensation costs, the company shall invoice the customer who caused the accident for the compensation or costs incurred.
  2. If a customer who has violated these terms of service by entering restricted areas managed by the facility, or someone who knows such a customer, issues a distress call or a customer who has left the managed area, or someone who knows such a customer, issues a distress call, the company shall notify the relevant public authorities and carry out rescue operations and/or provide logistical support. However, once rescue activities have concluded, the company shall invoice the customer concerned for all labor costs, snow equipment costs and any other costs incurred during the search and rescue.

6. Other Provisions

  1. Based on the Act on Prevention of Unjust Acts by Organized Crime Group Members, the company prohibits use by organized crime groups, members of organized crime groups, antisocial groups and members of antisocial groups (organized crime groups, extremist groups, and their members).
  2. Prohibition of flying drones and other radio-controlled aircraft
    While the use drones and other radio-controlled aircraft (including some wired vehicles) has become popularized within a short time in recent years, without a special permit, the flying of such aircraft vehicles is prohibited at the facility, above and around other facilities, and in areas that may be affected by the flying of such aircraft. In addition, large numbers of road vehicles and people move around the facility and other facilities. As drones and similar aircraft are heavy and have rotating blades, they have the potential to cause significant injury or damage in the event of a collision with people or objects. Flying such aircraft is therefore prohibited in order to avoid the risk of collisions caused by factors such as sudden strong winds, wireless communication issues, malfunctions, or operator error and to provide greater safety for people and property.
  3. Checking of admission tickets and violations
    Facility staff may ask Customers to present their admission tickets for inspection for purposes such as monitoring for unauthorized use and crime prevention. In the event that a person violates the provisions of these terms of service, facility staff will ask the person to present their admission ticket, check the ticket, and ask the person to leave the facility.
  4. Changes to these terms of service
    Changes may be made to these terms of service. Notification of such changes, the content of the revised terms of service, and the date on which the changes are to come into effect shall be published online or using other equivalent methods.
